Ngole (Appellant) v Touchstone Leeds (Respondent)
Monday 28 to Tuesday 29 September 2026
The Appellant contends that the Employment Appeal Tribunal erred in law in its treatment of the discrimination grounds, specifically in failing to find stereotyping, in misapplying the principles in Nagarajan, in its analysis of the distinction between holding and expressing a belief, and in remitting the matter to the same tribunal rather than a differently constituted one.
The Appellant had applied for a mental health support worker role in 2022. Following interview, the Appellant was offered the job. After, the Respondent gained knowledge of earlier litigation concerning certain beliefs held by the Appellant. The Respondent withdrew the offer, held a second interview, and ultimately declined to reinstate the offer. The Appellant then brought claims under the Equality Act 2010.
