By Appellant’s Notice filed on 12 January 2023, the Appellant appeals the Order of the Upper Tribunal Immigration & Asylum Chamber dated 19 December 2022.
Refusal of Leave To Remain as a business person under the European Community Association Agreement with Turkey (“ECAA”).
This followed refusal by way of administrative review. The refusal was because there was insufficient evidence to demonstrate that the business proposal met the requirements set out in the relevant guidance. The application was based on a proposed business as a hairdresser supported by a business plan asserting that he had the required experience and qualifications. The business required much travel between clients and the SSHD did not consider that it had a realistic prospect of success.
