By Appellant’s Notice filed on 24 April 2023, the Claimant appeals against the order made by Jay J dated 4 April 2023 on C’s application for summary judgment on the whole of the claim.

C played an interactive game on D’s website, The game was one whose outcome was predetermined by D’s computer system at point of purchase.

The predetermined outcome in C’s games was £10. But when games was played its software was subject to a coding error which resulted in C’s computer showing that she had won £1M.

After D explained the coding error to C and refused to pay the £1M, C began proceedings against D, claiming £1M as matter of contract. She also sought summary judgment.

The judge dismissed C’s application and found that her claim was unfounded.
