By Appellants Notice filed on 6 October 2022, the Claimant (C) below, appeals the Upper Tribunal’s decision dated 22 March 2022 dismissing C’s judicial review of the decision of the First tier Tribunal (Social Entitlement Chamber) (FTT) dated 18 October 2018.

C’s son, who was lawfully resident in the UK, was stabbed to death in a random attack in England on 27 October 2013. C, a Sri Lankan national, applied to the Criminal Injuries Compensation Authority (CICA) for compensation.

CICA’s decision dated 14 September 2016 deemed C ineligible as C did not have a defined connection as required by paragraph 10 of the Criminal Injuries Compensation Scheme 2012. CICA concluded C was not (i) a citizen of the UK or EU and/or (ii) was not ordinarily resident in the UK, although his son was.
