Pfizer Ltd and others v ModernaTX

The Appellants appeal against the Order dated 25 September 2024 of Mr Justice Meade sitting as a High Court Judge in the Business and Property Courts, Patents Court in which the Judge dismissed the claim for revocation of European Patents (UK) No. 3 590 949, revoked the European Patent (UK) No. 3 718 565, dismissed the Conditional Amendment application and made a costs order.

Pfizer is a pharmaceutical and biotechnology company and Pfizer is based in the USA. The Claimant BioNTech is a biotechnology company based in Germany. The Defendant Moderna is a pharmaceutical company based in the USA. In March 2020 Pfizer partnered to develop test and manufacture and distribute a SARS-CoV-2 vaccine. The issue in dispute was the validity of EP949 and EP565 regarding the use of messenger RNA vaccine as a method to prevent and/or treat coronavirus disease.
