PMC (a child by his mother and litigation friend FLR) (claimant/appellant) v A Local Health Board (defendant/respondent)

By appellant’s notice filed on 17 December 2024, the Claimant (PMC) appeals, with permission from Nicklin J, his order dated 22 November 2024, by which he refused PMC’s anonymity application.
High value clinical negligence claim arising out of PMC’s birth at one of the Defendant’s hospitals.
In 2016, the Defendant admitted liability for negligence in the care of PMC and his mother. Substantial interim payments were made by the Defendant before issue of the Claim in 2023.
PMC, a child, made an application dated 1 November 2024, for the Claimant (and his litigation friend) to be anonymised, the draft order also sought general restrictions on non-party access to unredacted documents from the Court’s records.
The application notice stated that the Defendant’s position was neutral regarding the anonymity application, a position maintained before Nicklin J.
The Judge felt the amount of material in the public domain as a result of prior publicity and the fact that earlier phases of the litigation have been conducted without any anonymity order makes any effort to anonymise PMC at this stage both unjustifiable and futile.
