By Appellant’s Notice filed on 29 June 2023, the Claimant (C) appeals against the order made by Heather Williams J dated 19 May 2023, sitting in the King’s Bench Division, striking out C’s claim form.
The Claimant was acting as the Representative Claimant to bring a representative claim for damages in the tort of misuse of private information on behalf of a class said to number about 1.6 million people.
The Defendants are Google UK Ltd and Deep Mind Technologies Limited.
The claim arises from the transfer of certain patient-identifiable medical records held by Royal Free London NHS Foundation Trust and its predecessors to D2.
A one-off transfer of historical data took place in October 2015 and a live data feed was established at about the time for subsequent medical records.
