Qasim (appellant) v The Secretary of State for the Home Department (respondent)

Tuesday 6 December 2022

The Appellant challenges the decision of the Upper Tribunal Immigration and Asylum Chamber dated 29 October 2021 and promulgated on 2 November 2021 which dismissed his appeal against the First Tier Tribunal decision.

The Appellant, a national of Pakistan, arrived in the UK in 2009 with leave as a tier 4 migrant valid until 2011. The Appellant’s subsequent human rights applications have been refused. In 2015 he was sentenced to 16 months’ imprisonment on a count of blackmail. The Appellant was deported on 28 February 2017, he then lodged a notice of appeal against the refusal of his human rights claim of 2 February 2017. The FTT dismissed his appeal, which was heard by a panel on 10 and 11 March 2020 by video link, after the panel accepted that the respondent had established that the appellant could have a fair and effective hearing via video link.

The UT dismissed the appeal, finding that the FTT panel had not erred.
