Appeal 1 – By Appellants Notice filed in the Court of Appeal on 12 September 2022, the Defendant (Hassam) appeals, with permission from DJ HENNESSY, the DJ’s order dated 22 June 2022, sitting in Birkenhead County Court, following a quantum assessment hearing on 8 June 2022.
The DJ’s order dated 5 July 2022 dealt with interest and costs; and granted the Defendant permission to appeal. The question of determination of the appeal was left to HHJ Wood to consider. Time for the Appellant’s Notice was extended to 4 pm 12 August 2022. The Notice was filed in the County Court on 11 August 2022.
HHJ WOOD’s order dated 6 September 2022 transferred the appeal to the Court of Appeal pursuant to CPR 52.23 (1). He commented that the appeal raises an important point in relation to the assessment of low value multiple injuries which include a tariff whiplash injury under the new scheme for small claims introduced by the Civil Liability Act 2018. Appellate guidance is needed.
Appeal 2 – By Appellants Notice filed on 12 September 2022, the Defendant (D) appeals, with permission from DJ Hennessy, paragraph 1 of the order of DJ Hennessy dated 13 July 2022 sitting in Birkenhead County Court, following a quantum assessment hearing,
The DJ’s order dated 28 July 2022 gave judgment for the Claimant in the sum of £3217.34 including interest, dealt with costs and granted both the Claimant and Defendant permission to appeal. The DJ also extended time to file the Appellants Notices to 19 August 2022. The Defendant’s appeal was filed in the County Court on 17 August 2022.
HHJ Wood’s order dated 6 September 2022 transferred the appeal to the Court of Appeal pursuant to CPR 52.23 (1) and directed it be considered in conjunction with another transferred up appeal of Rabot v Hussam.
Appeal 3 – By Appellants Notice originally filed in the County Court on 12 August 2022 and then filed in the Court of Appeal on 4 October 2022, the Claimant appeals with permission from DJ Hennessy, her order dated 13 July 2022 giving judgment for the Claimant in the sum of £3200 plus interest and adjourning the question of interest, costs and any ancillary matter to a hearing on 28 July 2022.
