Appeal 1 – By Appellant’s Notice filed on 20 July 2022, the Defendants appeal with partial permission, Order of Cockrill J. dated 25 July 2022. Permission was granted for the Claimants to appeal to the Court of Appeal from the Phase 2 Judgment on Ground 2 of the Proposed Grounds attached to the Claimants’ skeleton argument for the hearing of 25 July. Permission to appeal on the Claimants’ other Proposed Grounds was refused.
Appeal 2 – By Appellant’s Notice filed on 20 July 2022 and issued on 29 July 2022, the Claimants below appeal with permission granted on Ground 1 and seek permission to appeal on grounds 2 and 3, the Order of Cockrill J. dated 25 July 2022.
The proceedings concern the provision of Recovery Services. In November 2018, following a trial on the issue of liability, Cockrill J. held that Defendant 1 – 3 (D1 – D3) had breached the fiduciary duties owed to Claimant’s (C) in relation to the opportunity to provide Recovery Services. These appeals arise from the second phase of the proceedings which relate to the account of profits.
