By Appellant’s Notice filed on the 13 July 2023, this is an appeal against the decision of Garnham J dated 7 July 2023. The claimant sought to challenge the Secretary of State’s decision of 26 August 2022 to enter into Grant Funding Agreements in a total sum of circa £30 million under the Building Safety Fund (“BFS”) in respect of two high rise developments in Birmingham which were developed by and on behalf of the Appellants.

Following Grenfell, cladding defects were discovered in the developments and claims were made by leaseholders on the insurance policies in place. Liability was accepted by the insurer in respect of one development and it was expected to be in respect of the other. The claimants informed the respondent that resort should be made to the insurers in the first instance and that the respondent should not expect the claimants to reimburse the BSF where liability had been accepted/was likely to be accepted by the insurer.
