Both parties appeal against the order of the Employment Appeals Tribunal (EAT), Bourne J, dated 5 December 2023.
The issue is whether the EAT was right to find that the Claimant (a former employee of RESA) was entitled to proceed with a discrimination claim that was otherwise barred by state immunity on the basis that it included a claim for personal injury damages under the Equality Act 2010 said to have been caused/exacerbated by unlawful harassment and victimisation.
