Save Stonehenge World Heritage Site Ltd v Secretary of State for Transport & ors

Monday 15 – Wednesday 17 July 2024

By Appellant’s Notice filed on the 28 February 2024, the claimant appeals the decision of Mr Justice Holgate dated 19 February 2024 sitting in the Administrative and Planning Court.

The Appellant sought to challenge by way of judicial review under s.118 of the Planning Act 2008 the decision letter dated 14 July 2023 by which the Respondent granted the development consent order for the construction of a new dual carriageway section of the A303 13km long between Amesbury and Berwick Down, Wiltshire. The route crosses the Stonehenge part of the Stonehenge, Avebury and Associated Sites World Heritage Site.

Holgate J considered the application at a rolled up hearing and refused both permission to bring a judicial claim and permission to add a new ground.
