By the Appellant’s Notice filed on 26 March 2021, the Appellant appeals the decision of Bennathan J, dated 14 February 2022, ordering that the Appellant’s (Defendant below) assessment of the Respondent’s (SB) (Claimant below) age dated 11 June 2021 is quashed.
Background:- SB, a national of South Sudan, arrived in the UK on 28 May 2021 and claimed asylum, stating he was a child aged 17 years old. The applicant, the Royal Borough of Kensington & Chelsea (RBKC) carried out an assessment of SB’s age on 11 June 2021 and determined he was an adult. SB successfully challenged this assessment by judicial review, and Bennathan J ordered the assessment be quashed. RBKC now seeks to challenge that decision.
