Application of European Union law to the circumstances in which a recipient of Universal Credit (“UC”) is eligible for the Child Element of UC. Specifically, whether EU/Union law provides entitlement to Child Element where the UC recipient’s children or qualifying young person are not resident in the UK as a consequence of the explicit non-discrimination provisions in Regulation (EC) No. 883/20041.
