Appeal against the decision of the Upper Tribunal Immigration and Asylum Chamber dated 2 June 2021. National of Sri Lanka. Refusal of asylum. Risk as detained from 2009 to 2013 as thought to be a member of the LTTE or a collaborator who had acted for them as a driver. Further risk due to sur place activities with the TGTE. He arrived in 2013 and claimed asylum. This was refused and there followed a series of unsuccessful applications.

The First Tier Tribunal dismissed the appeal finding the account to be incredible and that the applicant’s sur place activities did not show genuine political motivation.

The Upper Tribunal dismissed the appeal finding no error of law- the FTT had meant that the account was implausible and not incredible.
