The Secretary of State for the Home Department appeals the quashing of their decision and the grant of judicial review. The Respondents had applied to extend their leave as an Overseas Business Representative but were refused.

During proceedings it emerged that the Respondents’ solicitor had been struck off for dishonesty and misconduct in unrelated cases, with behaviour closely resembling what appeared to have happened in this case. Judge Pinder found the Respondents had been entirely blameless and seriously disadvantaged by their solicitor’s failings. Although the Secretary of State acted lawfully at the time, the judge held that fairness required the decision to be revisited once the solicitor’s misconduct became known.
