This is the Secretary of State’s appeal against the Order of Cavanagh J. of 23 September 2022 by which she granted the Respondent’s judicial review claim to the extent that is was declared that: “the Defendant’s Decision Maker Guidance and Overview relating to third party deductions (“TPD”) from legacy benefits for water and fuel debts under Schedule 9 of the Social Security (Claims and Payments Regulations ) 1987, as it stands on 23 September 2022, is unlawful because by implication and omission it does not make clear that claimants should be offered an opportunity to make representations and/or provide relevant information to the decision maker before a TPD decision is taken.”
