The Appellant challenged, by judicial review, under s118(1) of the Planning Act 2008, the First Respondent, Secretary of State’s decision made under the Sizewell C (Nuclear Generating Station) Order 2022 (Si2022 No. 853)(“the Order”). The Order grants development consents for the construction, operation, maintenance and decommissioning of a nuclear power station to the Second Respondent.
