By Appellant’s Notice filed on 21 December 2023, the Claimant Tyson International Company Limited appeals with permission the order of Stephen Housemann KC dated 15 December 2023 by which he ordered:
i. The Claimant’s claim is stayed pursuant to section 9 of the Arbitration Act 1996:
ii. The ASI Application is dismissed;
iii. The Claimant shall pay the Defendant’s costs of the Stay Application and the ASI Application.
iv. The Claimant has permission to appeal: 2 a. The granting of a stay in (1) of this Order. b. The contingent refusal of anti-suit/anti-arbitration relief in (2) of this Order.
