The primary issue was the interpretation of jurisdiction and arbitration clauses within the Facultative Certificates and Market Reform Contracts (MRCs). TICL sought a final anti-suit injunction to prevent GIC Re from pursuing arbitration in New York, arguing that the English courts had jurisdiction based on the MRCs. The court had previously granted an interim anti-suit injunction, which was now made final.
