(1) By Appellant’s Notice filed on 8 September 2023 by Fourth Intervener (DELTA Merseyside Limited) appeals against the order made by Foster J dated 28 July 2023 declaring that in order to operate lawfully under Part II of the Local Government Act ( Miscellaneous Provisions) 1976 a licensed operator who accepts a booking from a passenger is required to enter as principal into a contractual obligation with the passenger to provide the journey which is the subject of the booking.

This was the declaration sought by the Claimant .

The first and second interveners supported this interpretation., whereas the third and fourth interveners opposed this interpretation. D remained neutral.

DELTA is a leading private hire operator in Merseyside..

The issue concerned the relationship between an operator under the 1976 Act (who accepts a booking from a passenger) and a passenger.

(2) The Third Intervener (Veezu Holdings Ltd) appeals the same order limited to question whether the wording of the declaration made by the judge was inappropriate in wrongly indicating that criminal liability arises in certain situations.
