By Appellant’s Notice filed on 21 September 2023, the defendant below, appeals the order of HHJ Jarman sitting as a High Court Judge in the Business and Property Courts in which he refused an application to strike out the Respondents claims as an abuse of process.
Background:
1. By a single claim form, 134 claimants claim damages against the Appellant firm of solicitors in respect of investments which they say they have lost due to the Applicant’s negligent professional advice.
2. The Appellant applied to strike out the claim as an abuse of process on the basis that it was not convenient to join all of the claims in one claim form when different advice was given to different claimants at different times regarding different projects.
3. The Judge was satisfied that there is a sufficient commonality in the claims for then to proceed in one claim form and dismissed the Appellant’s application
