By Appellants Notice filed 20 January 2021, the Claimant (C) appeals, with permission to appeal in part from Martin Spencer J, his order dated 5 January 2021, quantifying damages in his judgment dated 16 December 2020, following Mrs J Yip’s judgment on liability dated 18 December 2019.
Martin Spencer J gave judgment for C in respect of claims under the Law Reforrm (Miscellaneous Provisions) Act 1934 and the Fatal Accidents Act 1976 in the sums set out in the order.
The claim arises from a bomb attack in Hyde Park on 20 July 1982 for which the Irish Republican Army (IRA) claimed responsibility. Four soldiers, including C’s father, all members of the Household Cavalry, died and others were injured. Mrs J Yip found D deeply implicated in the planning and execution of the attack. Criminal proceedings against D collapsed in 2014.
