Appeal against the decision of Upper Tribunal Immigration and Asylum Chamber of 22 July 2022, to refuse permission for judicial review and permission to appeal to the Court of Appeal following an oral hearing.
The Appellants sought to challenge the SSHD’s decision to defer taking a decision on their applications for leave to remain as a Skilled Worker, dependant partner and dependant child respectively. On 28 July 2021 the Respondent wrote to the Appellants informing them that their applications would not be decided within the standard processing time due to “an outstanding criminal prosecution”. On 24 March 2021 the First Appellant was arrested on suspicion of money laundering and released under investigation pending a CPS charging decision.
