The Defendant (D) (former King of Spain) appeals against the order made by Nicklin J date 29/3/22 dismissing D’s application that the Court has no jurisdiction to hear the Claimant’s claim on grounds of state immunity.

The parties were in a relationship from 2004 to 2009.

C’s claim was that D was responsible for course of conduct amounting to harassment from 2012 to 2020 in breach of section 1 of the Protection from Harassment Act 1997.

The judge ruled that the grounds on which state immunity was claimed had not been made out and ordered that the claim should continue.
