By an Appellant’s Notice filed on 18 February 2020 the second Defendant seeks permission to appeal the order of Mr Justice Teare dated 28 January 2020 made in the Commercial Court, by which he allowed the Claimant’s application for permission to amend the Particulars of Claim.
The Claimant entered into an agreement with the 1st/2nd Defendants as sellers, for the sale of shares in companies comprising an online gambling operation. The Claimant claims they were induced to enter into the agreement by representations as to the financial status of the business, and that these representations were made fraudulently/negligently/within s2(1) Misrep Act 1967. 1st Defendant was acting in his own capacity and/or on behalf of 2nd Defendant so that 2nd Defendant is also liable for the deceit/misrepresentations.
