Update: Disclosure Review Working Group survey of legal sector stakeholders
The Disclosure Review Working Group (DRWG) has continued its work around the potential simplification of disclosure rules for the Business and Property Courts (BPC) via amendments to Practice Direction (PD) 57AD.
As explained in an update in May, an important element in the DRWG’s consideration of the functioning of disclosure in these courts are the results of a survey of legal sector stakeholders conducted at the end of 2025 and the beginning of 2026.
The DRWG is now publishing a summary of the results of that survey, available to download below, to assist practitioners and other users of the BPCs.
In recent months, the DRWG has conducted a series of meetings. It aims to produce proposals for the simplification of the regime in PD57AD, with a view to reducing complexity, front-loading and cost.
The DRWG will not be recommending a simple return to Part 31 of the Civil Procedure Rules.
It hopes to be able to consult on a series of recommendations later this year or early in 2027.
