Costs of Care
The cost of care is a very contentious aspect of catastrophic personal injury claims with limited guidance available in relation to the rules or case-law on when and how care experts should be instructed, on the most helpful format for their reports and on the factors judges should take into account in deciding these claims.
The Civil Justice Council, along with the Ministry of Justice and other key stakeholders, therefore drafted guidance and invited comments on the utility of the draft guidance by Monday 8 March 2010. A summary of responses was published in June 2010.
