Small Claims

Objectives

In January 2021 a working group was formed by the Master of the Rolls to look at the resolution of Small Claims. The working group comprised of experienced District Judges from large, medium and small court centres.

In April 2021, the working group produced an interim report, The Resolution of Small Claims (PDF, opens in a new tab). The interim report recommended issues for further consideration which will be looked at in a second phase of work, reporting later in 2021:

a) Proportionality and the small claims procedure (including whether there should be different rules for claims under a modest financial limit)
b) Pre-issue and post-issue mediation
c) Pre-issue information
d) Better guidance for litigants and directions in simple language
e) Harmonisation of directions
f) The impact of the changes to road traffic accident personal injury claims
g) Written/template judgments
h) Guidance as to when the remote hearings may be appropriate in small claims.
